PATNA:एडवोकेट लक्ष्मण चंद्रा विक्टोरिया गौरी को मद्रास हाई कोर्ट की जज बनाने के खिलाफ याचिका को सुप्रीम कोर्ट ने ख़ारिज कर दी. वकीलों का कहना था कि गौरी भाजपा की नेता है, उन्हें जज बनाना न्यायपालिका की स्वतंत्रता के लिए अच्छा नहीं है.वकीलों को विक्टोरिया गौरी के इस्लाम को हरा आतंक और ईसाई को सफेद आतंक बताने वाले बयानों से भी आपत्ति है.गौरी के अपॉइंटमेंट के खिलाफ मद्रास हाईकोर्ट 22 वकीलों के ग्रुप ने सुप्रीम कोर्ट में याचिका दाखिल की थी.
गौरी के खिलाफ वकील ने उनके पॉलिटिकल बैकग्राउंड का हवाला देते हुए दलील दी कि जज की शपथ लेने वाले व्यक्ति की संविधान में पूरी आस्था होनी चाहिए.सुप्रीम कोर्ट ने कहा कि पहले भी ऐसे मौके आए हैं,जब पॉलिटिकल बैकग्राउंड वाले लोग सुप्रीम कोर्ट में भी जज बने.करीब 22 मिनट सुनवाई के बाद सुप्रीम कोर्ट ने इस याचिका को खारिज कर दिया.सुप्रीम कोर्ट में सुनवाई के बीच विक्टोरिया गौरी ने मद्रास हाईकोर्ट में जज की शपथ ली.
जस्टिस संजीव खन्ना ने कहा कि पहले भी ऐसे मौके आए हैं, जब राजनीतिक पृष्ठभूमि वाले लोगों को अपॉइंट किया गया है.जिन बयानों का जिक्र किया जा रहा है, वो 2018 के हैं.मेरा मानना है कि गौरी के लिए रिकमंडेशन से पहले कोलेजियम ने निश्चित तौर पर इन पर भी विचार किया होगा.अपॉइंटमेंट के खिलाफ दलील में कहा गया कि सवाल पॉलिटिकल बैकग्राउंड का नहीं है। यह हेट स्पीच का मामला है। हेट स्पीच वह चीज है, जो पूरी तरह से संविधान के खिलाफ है। इसी के चलते गौरी जज की शपथ लेने के लिए अयोग्य हो जाती हैं। ये केवल कागजी शपथ होगी.
